Missouri Helemet Update

Here is some info on the status of the Helemt Modification bill in Missouri thanks to our friend Greg (halfbreed) Mullanix, Legislative Co-Ordinator for FORR. This bill will allow motorcyclist over 21 to ride without a helmet in Missouri while NOT on an interstate highway.
"For those of you who do not know we passed out of the House tonight 93 yes 62no and no amendments. We need to thank Rep. Gary Dusenberg he worked his ass off for us (gary.dusenberg@house.mo.gov ) or 573-751-1487.
The next step is the governor desk, of which we are supposed to have an agreement with the governor."
Later he added the following explanation:
" Could not sleep so I thought I would explain some things. SCS/SB202 is the comparative fault and helmet modification bills all in one. We have an agreement with the Governor that he will not sign the bill but will let it set on his desk and become law anyway. The only stipulation was that it could not have a bunch of other stuff attached. We have done our part; this is as clean a bill as I have seen in a long time. What we need to do is encourage him to allow SCS/SB202 to become law. If he does this the effective date would be August 28th. Even if he would sign it it would still be august 28th."

My congratulations to my friends in Missouri for getting the bill this far. It seems like victory is at hand. I wonder though is this really a good bill. It seems in some ways that the penalties in the future will be worse. If my understanding is correct if you get caught riding without a helmet on the interstate that will cause you to lose your privilege for a year as opposed to the $25 dollars right now. Is a bad bill better than no bill at all, that is the question I think.

Section 302.020, RSMo, of the amended bill spells out that the fine continues to be $25 for not wearing protective headgear on an interstate highway. The amended language reads:

"Any person twenty-one years of age or older operating or riding as a passenger on any motorcycle or motortricycle without protective headgear upon an interstate highway shall be guilty of an infraction for which a fine not to exceed twenty-five dollars may be imposed."

The original law also states that no court costs shall be imposed, nor shall any points be assessed against the license of an operator found guilty of violating the headgear section of the law. I see no language in the law, original or amended, that infers that violators would lose their endorsment and/or license for a year.

I was at a shop last week and the owner was saying that. I have not truly read the bill so I probably should have said nothing until I was sure of the facts. Thanks for helping to straighten me out.
